Terms of Service

These Terms of Service ("Terms") govern your access to and use of Didactora, a web-based e-learning authoring product operated by Elias Zauda ("Didactora", "we", "us", or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.
1. Who we are
Didactora is operated by Elias Zauda, a sole proprietor based in Israel. You can reach us at support@didactora.com with any question about the service or these Terms.
2. The service
Didactora is a tool for creating interactive e-learning courses in your browser and exporting them to standard formats such as SCORM, xAPI/cmi5, and HTML5. Features and availability may change as the product evolves, and some capabilities are offered only on specific paid plans.
3. Your account
To use most features you must create an account and provide accurate, current information. You are responsible for all activity under your account.
- You must be at least 16 years old, or the age of digital consent in your country, to use Didactora.
- You are responsible for keeping your password confidential and for restricting access to your account.
- Notify us promptly at support@didactora.com if you suspect any unauthorized use of your account.
4. Plans, billing, and renewals
Didactora offers a free plan and paid subscription plans. Paid plans are billed in US dollars through our Merchant of Record, Paddle, on a monthly or annual cycle that you choose.
Paid plans renew automatically at the end of each billing period until you cancel. You can cancel at any time from Settings > Billing. Prices, taxes, refunds, and cancellations are described in our Refund & Cancellation Policy, which forms part of these Terms.
We may change our prices from time to time. Any price change applies only to billing periods that begin after we notify you.
5. Free plan and limits
The free plan is provided for evaluation and personal use and is subject to usage limits, including the number of projects, available export formats, and storage. We may adjust free-plan limits over time.
6. Your content
You retain all rights to the courses, text, images, and other materials you create or upload ("Your Content"). We do not claim ownership of Your Content.
You grant us a limited license to store, process, and display Your Content solely to operate and provide the service to you, for example to save your projects and generate exports. This license ends when you delete the content or close your account, except for backups retained for a limited period.
You are responsible for Your Content and for ensuring you have the rights and permissions needed to use any third-party materials, including fonts, images, audio, and video, that you add to your courses.
7. Acceptable use
You agree not to misuse the service. In particular:
- Do not use Didactora for any unlawful purpose or to create or distribute unlawful, infringing, or harmful content.
- Do not upload malware or attempt to disrupt, overload, or gain unauthorized access to the service or its infrastructure.
- Do not reverse engineer, decompile, or attempt to extract the source code of the service, except to the extent this restriction is prohibited by law.
- Do not resell, sublicense, or provide the service to third parties except as expressly permitted by your plan.
- Do not infringe the intellectual property or privacy rights of others.
8. Our intellectual property
The Didactora software, website, design, and the Didactora name and logo are owned by Elias Zauda and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without our prior written permission. All rights not expressly granted to you are reserved.
9. Third-party services
We rely on trusted third parties to operate the service, including Paddle for payment processing and Cloudflare for hosting and infrastructure. Your use of the service may be subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.
10. Disclaimers
The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that it will meet your specific requirements. You are responsible for keeping your own backups of important content.
11. Limitation of liability
To the fullest extent permitted by law, Elias Zauda will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Elias Zauda from any claims, damages, or expenses arising out of Your Content, your use of the service, or your violation of these Terms or applicable law.
13. Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms or use the service in a way that risks harm to others or to the service. Where reasonable, we will give you notice and an opportunity to resolve the issue. On termination, your right to use the service ends; provisions that by their nature should survive, such as ownership, disclaimers, and limitation of liability, will survive.
14. Changes to the service and these Terms
We may update the service and these Terms from time to time. If we make a material change to these Terms, we will take reasonable steps to notify you, such as by email or a notice in the product. Your continued use of the service after the change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. You agree that the competent courts of Haifa, Israel, will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service.
